Profiling does not take place in a vacuum and investigators rely on any evidence found at a crime scene to draw conclusions. Other important aspects police consider are the crime location, the circumstances of the crime, whether it is similar in nature to another crime (using the same modus operandi), if there is any physical evidence left behind, or weapons used that may have been used in other crimes. Police use blood spatter analysis, fingerprinting and casting on scene as well to get a picture of the individual who may have committed the crime.

Criminal profiling also goes by another name, offender profiling. It is defined as the method or process used to attempt to get a handle on the characteristics and mindset of an unknown offender or unsub (unknown subject/suspect).

Solving crimes takes more than 40 minutes with commercials thrown in and major luck getting big breaks. It is a long process involving a number of tools, and one of them happens to be criminal profiling. Police use it most often to assist in solving particularly egregious crimes, such as murder, kidnapping and sexual assault. When it comes to attempting to put together a profile, all aspects of the crime come into play, from the smallest, seemingly inconsequential detail, to the possible discovery of a weapon with fingerprints.

Part of the benefit of criminal profiling is that the results may indicate a pattern that helps narrow down many facets of the case. Profiling can elucidate details about the unsub, such as whom the individual might be and what risks he or she took to commit the crime, the latter indicating intelligence and planning versus a crime of passion.

In addition, elements of setting can come to light, like where the suspect usually carries out the crimes, and what the motive for the crime appears to be. The preliminary answers to these, and other questions, usually provide investigators with a good sense of whom they may be hunting.

Forensic evidence is not the only element that makes up a criminal profile. It involves, but is not limited to, victim characteristics, crime scene evidence and even detective/profiler intuition. Information gleaned from a criminal profile can include intelligence, sex, approximate age, race, religious beliefs and psychological traits. Though this methodology is useful, it has its flaws, because it produces educated guesses rather than exact answers. It also opens the door to stereotyping, which could lead to false profiles. Some view criminal profiling as a pseudoscientific technique.

This tool has many advantages, including the ability to detect criminal behavior patterns, which saves time hunting for the perpetrator, and predicts where the criminal could be active in the future. Profiling cannot take place without a very detailed analysis of the crime scene done by forensic investigators.

Let’s call my son Johnny. He has a neurological impairment and is ambulatory and impressively articulate. These are my views and perceptions as his mother. I hope the points that I will highlight will resonate with readers. I also hope that some of you will be motivated and proactive in not only making a transition plan but making that plan a reality that is sustainable and seek guardianship, before your child reaches the age of majority if appropriate.

My Story

We live in a great school district in Westchester County.   My son had had a number of medical interventions and we had a relatively sound understanding of our challenges.   Yes, we all know that each child is different and has different needs. My son moved up in grades, followed the Regents track, though he was always in special education classes.

In high school, it all came crashing down and it became apparent to everyone that a Regents diploma was not going to become a reality (for him).

Despite the fact that he had a transition plan and even a transition coordinator set in place in our district, Johnny was no longer interested. As of 11th grade, my son did not want to go to school anymore, thinking it was a huge waste of his time. His CSE agreed that if he didn’t want to attend school there was no way to force him. At that juncture and to my dismay, he was over 18, guardian- less, and therefore emancipated and able legally to make his own decisions about life. Legally, I learned that few options exist for parents to exercise control and supervision over a child after he or she turns 18, whether a child is in school or not.   Johnny had not, in the true legal sense of the word, transitioned out of school nor had he transitioned into anything else.

He became more and more out of sync with so many and so much. I watched him, helplessly, as he sat around, slept, played video games, watched TV and frequented CVS to buy candy. This went on for over two years.

I tried many different courses of action: I called adult protective services, the police, the pediatrician, and the neurologist. I cried to friends and family members. I even called Mental Health Association (MHA), who told me in writing that if Johnny wasn’t a threat to himself or to others, they could not do a thing to help me.

What was my problem? My child, a young adult now, was sinking: disengaged, with challenges no meaningful pursuits and no high school degree. My other children, Johnny’s siblings, were progressing.   We all felt aggrieved, irritated, frustrated and distressed.

I could find no one, nowhere, no how to help me and Johnny!

There were a number of contributing factors to our rough patch:

1. In as much as he was motivated, he always felt as if he had been pulled down. He was never fully accepting of his own challenges albeit he was extremely knowledgeable of his interventions.

2. I (his mother), had not fully understood that money cannot buy a young adult with a disability services.

3. All of the professionals who had worked with my son had always seen my son as ‘on the fence’; he straddled two worlds; mainstream but not, non-mainstream yet so articulate and able.

Finally, it was made clear to me that the only one who could help my son…was me. I asked myself over and over, “What is appropriate for my son?”

The convergence of these factors made the later years of high school and post-high school a living disaster. I realized that the only way to access county, state and federal services was for him to be in the system and that was a scary thought for me to grasp.

I made one and only one resolution that year: I was going to move my son to a ‘better place’. I didn’t have an idea what exactly that meant nor did I know what that would look like but I committed to knowing for a fact that the status quo absolutely was not working: not for him, me, or the rest of the family.

Since no agency could help, it had to be me. I had the power because Johnny lived in my house with me – otherwise, I realized, I would have had no legal authority over him.

Johnny already had his OPWDD eligibility. I visited Social Security, ACCES VR, and interviewed Medicaid service coordinators (MSC).   For the record: if you are NOT happy with your MSC you can and SHOULD change them. There is absolutely no reason for you to stay with someone who is not helping you/ your child.

8 months later… Everything is in place!

Johnny has a new Medicaid service coordinator, who has visited my son numerous times (over the course of just six weeks)! I rented an apartment less than one mile from my house for one year. Johnny is set up there. I buy his groceries; he comes with me, is engaged and helpful. He even washes his sheets – I couldn’t get him to ‘allow’ me to clean his sheets when he lived at home, but now, we are learning how to do laundry and have washed his new sheets. Life is good. Johnny is 1000% more engaged in his life, I am happier, his siblings experience calmness in their home, ACCESS VR is helping Johnny find a job and our MSC is on the case!

What to learn from my experiences:

  1. You can ask 100 people their opinion regarding your child but only you can change the status quo.
  2. Don’t be afraid — Change is good!
  3. We need to organize our kids’ lives so that when we are not around their life can continue and flourish!

If I could impart one piece of advice based on this experience and my knowledge: Sort out a transition plan for your child before he or she reaches the age of majority and seek guardianship, if appropriate. The age of majority is legally 18 in New York; regardless of whether your child has a disability or not.Take these steps before he/she exits high school. Contrary to popular belief, these two moments in time are not necessarily the same as your child may be entitled to exit high school at 21 years of age.

A Texas television station’s chief meteorologist has sued his former employer, claiming age and disability discrimination.

Bob French has filed the federal discrimination lawsuit against KBTX in College Station and Bryan. He has also claimed retaliation, harassment and violations of the Federal Family and Medical Leave Act.

French alleges that during the 2012 holidays, he was forced to work additional hours while younger staff members were given time off. He claims that the overwork led him to seek medical treatment for exhaustion and depression in 2013 under the Family and Medical Leave Act. 

According to the lawsuit, KBTX advertised an open meteorologist position during the time that French was on protected medical leave. French claims that when he returned to work, he was reprimanded and soon replaced by a meteorologist who was under 40 years of age and did not have a disability.

According to the lawsuit, French had worked for the station for 23 years, and his employment was governed by a written contract that stated that he could not be fired without cause. French said that none of the reasons given for his firing constituted proper cause.

French previously filed charges with the Equal Employment Opportunity Commission and the Texas Workforce Commission, alleging discrimination and retaliation. The EEOC completed an investigation in May, clearing the way for the lawsuit to be filed.

Today, former judicial Assistant Alisha Rupp was sentenced to the charges she pled to last week.  Judge Perry of Orlando sentenced Rupp to 300 days in the Polk County Jail, followed by 185 days house arrest, and 2 years probation.  The judge also adjudicated her guilty which means Ms. Rupp is now a convicted felon and can not seal her arrest or remove her mugshot from the Polk County Sheriff’s webpage.  If the judge had withheld adjudication, she would not have lost her civil rights and would be eligible to seal her record.

Ms. Rupp also must pay “restitution” in the amount of $4,879.00.  Restitution is payment for any damages or loss you may have cost the victim in your criminal case.  For example, if someone stole a television and sold the TV to some unknown person and the TV was never recovered, the defendant would be ordered to pay or reimburse that person for the stolen TV.  There are many times when restitution can not be ordered in a case and even more often when the amount of restitution or amount owed can be disputed by the person convicted of the crime.  If you have been ordered to pay restitution or think your case may require restitution, call for a free consultation about defense you may have to paying these monies.  In Ms. Rupp’s case, she will be paying back the money she received for work when she was not actually working.

Judge Perry gave a jail sentence even though Judge Harlan’s charges were dropped.  The judge stated that as a judicial assistant, Rupp violated the public trust of the position.  Based upon the sentence today, prosecutors dropped the remaining 13 counts against Rupp that were recently added to her criminal charges.  Ms. Rupp’s defense attorney requested probation as a sentence.  Rupp also asked for a “turn-in” date for her jail sentence, but Judge Perry refused and ordered that she be taken into custody immediately. Defense attorneys often ask for “turn-in” dates so that our clients can get their affairs in order, but I am sure the judge considered the fact that she pled last week, had time to get her affairs in order, and due to the “public trust” involved in her case, that a turn-in date would not be appropriate.

This ends the Polk county scandal as both cases are now finished.  A judge will still have to be appointed for Judge Harlan’s vacated spot on the bench.

Athletes are not the only members of today’s society who run the risk of sustaining a traumatic brain injury (TBI). Seniors can succumb to them as well, and the repercussions can be severe.

Seniors living in long-term care facilities tend to run a higher risk of falling and hitting their heads than those in other living situations. According to a study published in the Canadian Medical Association Journal, when seniors fall, they almost always hit their heads — even if they throw out their arms to break the fall. The video study was conducted at Simon Fraser University in British Columbia, but the results cross borders; the risk is just as great in U.S. elder care facilities.

According to the study’s findings, over 60 percent of hospital admissions for TBIs are for seniors over the age of 65. The incidence rate escalates gradually among more elderly seniors, and then increases more sharply once seniors pass 80 years of age.

Researchers set up cameras in public areas of nursing homes, such as lounges, TV rooms and hallways to take 39-month, in-depth look at falls. They sought to observe the physical mechanics of a senior’s fall and the body parts that took the main brunt of the impact with the ground. Over 133 residents were recorded during their daily lives in the home.

227 falls were ultimately analyzed. In 37 percent of those falls, seniors hit their heads (most frequently on the ground). Although no concussions were noted on any resident’s file in this study, the risk was still treated with caution; concussions can mimic traumatic brain injuries. Surprisingly, most seniors who threw out their arms were not able to minimize the impact in a significant way. Their arm muscles were too weak to offer any kind of mitigating support.

Overall, home residents hit their heads on the floor in 64 percent of the videos examined. 16 percent made contact with furniture and 13 percent hit a wall. 33 percent of those who hit their heads on any of the above sustained a full range of injuries, from cuts and bruises to fractures.

With enough study of mobility biomechanics, homes hope to change the way seniors navigate their environments. Analysis might help medical professionals design room layouts that improve mobility or exercise programs focused on stability and balance.
Now that the results of such studies have been published, will it be considered negligence if nursing homes and long-term care facilities do not improve environment safety? For example, most homes currently have hard surface flooring, such as linoleum or tile, to facilitate cleaning. Should they be expected to use compliant flooring that cushions a fall and helps avert head injuries instead? Falls account for approximately 95 percent of serious hip fractures and other debilitating, potentially life-shortening injuries. Any step towards safety and protection is a positive one.

It’s food for thought, but on first consideration, it does seem that nursing homes may face personal injury lawsuits if they do not provide a safe environment when they know of, or should know of, suggested improvements.

If you don’t have a pet, you might not understand how important and difficult this question can be but if you have ever felt the special bond between a person and a pet, you can imagine how custody issues of pets can be difficult in a divorce. When spouses with children divorce, the court determines whether the parents will have joint custody or if one parent will have sole custody. Courts also provide parenting time schedules for children so both parents have parenting time with the children.

The overriding factor in custody and parenting time decisions is the best interests of the child…not the best interests of the parents. Focusing on the best interests of the child makes custody decisions easier for parents and courts alike because there is enough research on what is best for children in many different situations. If the court were to treat pets like children, they would have to determine what is in the best interests of the pet and that is not something courts are likely to do because court resources are in high demand for more pressing matters. As far as the best interests of the pet, pets are generally fine as long as they have food, water, shelter, perhaps a walk, and someone to give them attention.

Just as not all parents are married, not all pet owners are married either. Roommates, partners, friends, and family might get a pet together and when they go their separate ways, the pet owners may not agree on who should have custody of the pet. For all these situations, courts do not have a process by law to award custody. Some individual courts have made rulings for custody of pets but generally speaking those decisions were left up to the court’s discretion and were not really based in state law.

Pets Are Property

Interestingly, pets are considered property by law so they are treated like property in a divorce. Property includes real property (a house) as well as items such as furniture, electronics, and jewelry. When dividing property, spouses generally each receive property of equal value. One spouse might get the big screen TV while the other spouse might get the china and glassware which has the same value as the TV. How do you put a dollar value on the family pet?

While courts will not typically decide issues regarding pets (there really aren’t any laws for courts to follow regarding pets in divorce) individuals can stipulate their own agreement in regard to family pets. Families with children sometimes decide that the pet should be where the children are. In those cases, the pet follows the same parenting time schedule that the children follow. In some cases, just like property, one spouse might negotiate a deal where he keeps the pet and he offers other types of property in exchange for the pet.

You should NOT have a non-attorney clerk at your hearing?  This seems obvious, but several Florida law firms and any company identifying themselves as “Experts”, some who are advertising on TV, are sending non-attorney clerks to Social Security Hearings simply because its cheaper for them to do so rather than have an actual attorney appear. How in any way is this helping the client or claimant to have poser clerks represent you? It’s not, it is just a costs saving to that particular company and is in no way beneficial to the client. Why pay the same to a clerk when you can have and are entitled to an actual Florida Bar licensed attorney.

Many clients who are unfamiliar with the Social Security representation paperwork are confused because the law firms often have an attorney and then a non-attorney sign the documents for the Florida law firm. Don’t be confused! Never ever let a non-attorney sign any documents. Always ask to see your representatives Florida Bar Card. If he or she does not have one find a lawyer who does immediately.  Especially ask the person to show you their Florida Bar Card at your hearing! If that person does not have a Florida Bar Card or can not give you his or her Florida Bar number, DEMAND and assert your rights at the Hearing for an actual attorney.   The Judge must grant you time to obtain an actual attorney.

There are non-attorney representatives who can represent you at the hearing which first came into being because the SSA Disability process was established to allow access to all in an informal manner. However, informal or not your Social Security Hearing is often the “final chapter” of a three year or more long battle. In other words, your final chance to win in consideration of all of the evidence.

It is shocking to think that many claimants leave the task of proving up their claim to non-attorney, often unskilled, without even the requirement of a high school diploma, representatives. In other words, claimants that would typically not hand over the future of tens of thousands of dollars are doing just that with a non-attorney representative.

Even more shocking, law firms who even advertise about representatives “hurting you”, are in fact the same, where they send non-attorney clerks to your hearing. Very true and very sad fact of the confusing process where you think a regulated law firm has your best interest in mind, but then send clerks to do a lawyers job.

Words of advice: don’t enter into any agreement with a non-attorney representative even if an attorney also signs the document. Do not let some Tom, Dick or Harry non-attorney poser represent you at your most important hour of need. Beware, any company calling themselves “Disability Experts” which are in fact, all poser-clerks and NOT even remotely associated with a lawyer. Often these so called  ”Disability Experts” try to tell you, we “work with lawyers” to mislead you in thinking somehow a lawyer is looking at your case, when in fact this will never happen while the “Disability Expert” has your claim. Notably, non-attorney clerks can never appear in Federal District Court, so after you lose your hearing then an actual attorney by law can only represent you in Federal District Court.

Make sure you have an actual Florida Bar Card license holding attorney at your hearing, if you don’t, then immediately tell the Judge you want a real lawyer and not a non-attorney clerk.

The Florida legislature has adopted a new standard for the admission of expert witness testimony in Florida criminal and civil cases.  In the past, Florida courts have used the Frye standard which allowed an expert to testify if the expert opinion was based on a scientific technique that is generally accepted as reliable in the relevant scientific community.  The Frye “generally accepted” standard is being replaced by the “Daubert” standard which comes from the United States Supreme Court case Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993).

The Daubert rule has been codified in Federal Rule 702 “TESTIMONY BY EXPERT WITNESSES” which states:

A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:
(a) the expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;
(b) the testimony is based on sufficient facts or data;
(c) the testimony is the product of reliable principles and methods; and
(d) the expert has reliably applied the principles and methods to the facts of the case.

Basically, Daubert makes the judge the “gatekeeper’ in determining whether scientific evidence is admissible in court.  The Daubert test is designed to broaden the judge’s authority to admit evidence that was not acceptable under the Frye test, because, although credible, the scientific evidence was not generally accepted.

This will allow criminal defense attorneys to challenge scientific evidence under the new standard such as field sobriety tests.  It will also allow defense attorneys to potentially get evidence into court that was previously inadmissible such as lie detector tests.

Science is increasingly playing a major role in criminal cases.  This includes DNA evidence, fingerprints, arson, forensic computer analysis, shaken baby syndrome, hand writing analysis, etc.  One reason why shows such as “CSI: Crime Scene Investigation” are so popular on TV.  Because of this, I attend national seminars on forensic sciences so that I can keep up with the latest developments and case law regarding scientific evidence.  Not only did I just attend the National Association of Criminal Defense Lawyers’ seminar “Making Sense of Science VI”, this evidence is so important I ordered the DVD of the seminar so that I can refer back to it when I need this information to defend my clients in court.  Many criminal defense attorneys and prosecutors are unaware of this major change in the law.

George Zimmerman’s trial began this week.  Many people and “experts” on TV have endless opinions on this case.  I use the term “expert” because many never try cases or are just on TV to create controversy or be critical just to be critical.

Most people gave high marks to the prosecutor for the State’s opening statement.  The prosecutor did an effective job to create emotion with their very first words.  The prosecutor also did a good job of creating a story and images that will stay with the jurors throughout the trial.  I think he used the expletives too much and did not have to repeat them so much, but a very effective job.

The defense on the other hand opened with a “knock, knock” joke.  In a murder trial.  That is a horrendous start in my opinion.  You only get one chance to make a first impression.  The defense made it worse, by harping on the “joke” by saying “C’mon, that was funny.”  A case this serious, with this much controversy, must be treated with respect.  It puts the defense in an early hole in the juror’s minds.  Another complaint by many people was that the defense did not tell a compelling story in opening.  Opening statements are a road map for the jury as to what the case will be about and what evidence the jury can expect to see.  A good defense attorney tries to paint a picture that places the jury at the scene of the incident.  In this case, you want to make the jury feel the fear George Zimmerman would have felt that night.  He is in a dark area, there are repeated criminal episodes in this area, when all of the sudden, a hooded figure turns and bears down George Zimmerman left to wonder what is about to happen to me?!?”  Instead, we remember the “knock, knock joke”.  Hopefully, the defense will get better as the trial continues.

World Elder Abuse Awareness Day is June 15.

While there is much made of child and domestic abuse in the media, elder abuse falls on deaf ears. Contrary to public perception, elder abuse is not confined to institutions, and happens in the community.

June 15 is World Elder Abuse Awareness Day. Now is the time to get acquainted to the signs of elder abuse: someone you love may be a victim.

There a number of different forms of abuse: financial, emotional, physical/sexual and neglect. In each of these cases, the older person is often isolated from other people, and seems to live in fear of their caregiver.

Signs of financial abuse

  • Unusual activity in someone’s bank account, or strange signatures on their bank slips

  • Pressure by family members or acquaintances to be given signing rights or power of attorney even if the older person is quite capable of managing their finances

  • If the older person has unpaid bills, or their electricity is cut off, it could mean that the person who was supposed to pay the bills has pocketed the money

  • If someone is well off, but they are placed in a nursing home that doesn’t reflect their financial status, it could also be a warning signal

  • If someone supposedly has money, but they lack necessary personal items or electronic goods such as a TV, their money may be siphoned off elsewhere

Signs of emotional abuse

  • The person is agitated for no apparent reason

  • The person seems helpless and/or is fearful and is scared to do things that were not a problem before

  • He/she is hesitant to talk openly

  • He/she is depressed, withdrawn, angry

  • The person tells implausible stories to explain certain things

Signs of physical abuse

  • Regular unexplained cuts and bruises

  • Poorly cared for injuries that may be hidden under clothing

  • Malnourishment

  • Poor skin condition or hygiene

  • Weight loss

  • Uneven hair loss

  • Soiled clothing or bedding

  • An untreated medical condition

  • The wearing of inappropriate clothing for the weather conditions

Neglect can occur both actively and passively, and often involves depriving an older person of essentials like food, water, warmth, medical treatment or clothing. Sometimes this is done on purpose, and others, ignorance.

Often times when elderly are abused they are reluctant to accuse their children or grandchildren openly, especially if they’re dependent on them in any way.

Melody Leonardo, the eldest daughter, made it all the way to Fresno to try out for the celebrated long-running trivia show with the host, Alicia Tribeca. She was a sure shoe-in to make it on the show, surpassing her peers after each level, for she was fed trivia questions when she was in her mother’s womb.

Her mother was a waitress at the local coffee shop and her father sold appliances at the mall, so she did not come from an upstanding intellectual household. It was not fair that the guys were able to go fishing in the Florida Keys and leave them with the kids, as they did periodically. Scott Boroughs was always a gangly kid who felt out of place with his peers. He had only one best friend growing up who was practically as awkward as he was.

During baseball season and many years walking past the sandlot as a kid, always watching from a distance, he never knew the fascination of baseball. Every boy got it and now every girl in America, too. His father and grandfather, who were both life-long California health insurance agents, talked about it and obsessed about it – but it all sounded like a foreign language to him. Somehow it was supposed to mean something.

But there she was. In her baseball cap, sitting alone in the corner of the bar, watching her team intently and silently rooting for them. Scott felt his heart thump faster and didn’t know why. She looked up and smiled at him briefly, then looked back at the TV.

Scott was just going to grab a beer and leave since this was the only hotel bar around. Being that it was a sports bar, he wasn’t even going to go in, but was glad he did. Scott sat next to her in silence. Finally she asked him who his favorite team was.

“I don’t have one,” he said reluctantly.

A disappointed look went over her face.

Scott went to bathroom and hurriedly called his buddy, Matt Lockard, a California health insurance agent, to help him out. Matt told him what to say to her, play by play.

However, when Scott caught the ball, he stood up for one brief moment to find that he was teetering at the edge of the railing and fell over the balcony with a big thud.

The cameras caught Scott’s heroic catch and blunder, and all of America saw Scott’s instant replay that even went viral on the Internet, that he became an overnight sensation.
