Medicare Advantage and Prescription Drug Plans<\/h3>\n

Medicare Part C. commonly known as Medicare Advantage, is a\u00a0Medicare substitute program operated by private health insurance\u00a0companies as a managed care plan. Medicare Part D similarly\u00a0provides prescription coverage to eligible beneficiaries through private\u00a0insurance plans. To the extent a reimbursement right may be created\u00a0under a specific MAO plan, the Part C statute itself limits any recovery\u00a0from a beneficiary to the amount actually received from a third party\u00a0as payment for plan-covered expenses.1<\/p>\n

ERISA Plans<\/h3>\n

Generally, employer-sponsored benefits plans are governed by the\u00a0Employee Retirement Income Security Act of 1974, commonly referred\u00a0to as ERISA.2 However, certain employers and their benefits plans are\u00a0not subject to ERISA.
