\nThere are a number of situations in a personal injury case where\u00a0probate issues must be addressed. Most Personal Injury attorneys
\nwork with experienced Probate Counsel to ensure that the process\u00a0goes very smoothly. Once the Executor or Administrator has been\u00a0appointed, that person may serve as Plaintiff in the litigation. If\u00a0the Plaintiff dies during the course of the litigation, the Executor or\u00a0Administrator may be substituted as Plaintiff on behalf of the estate.\u00a0Situations Requiring Probate Counsel
\n\u2022 Wrongful Death Cases. One or more persons are deceased and\u00a0a personal representative, either an Executor or Administrator,
\nmust be appointed to prosecute the claim in trial court.
\n\u2022 Plaintiff Dies During Litigation. Occasionally, a plaintiff will\u00a0die during the course of litigation, and a personal representative
