In Florida, a person is guilty of DUI if they are driving a \u201cvehicle\u201d while impaired.\u00a0 Notice that \u201cmotor vehicle\u201d is not used in this statute.\u00a0 The definition of a \u201cvehicle\u201d determines whether or not a bicycle would qualify for a DUI, which is:<\/p>\n
\u201cVehicle\u2019\u2019 is every device, in, upon or by which any person or property is, or may be, transported or drawn upon a highway, except devices used exclusively upon stationary rails or tracks.\u00a0 Florida Standard Jury Instructions 28.1.\u00a0 Florida courts have also held that a bicycle qualifies for a DUI.\u00a0 State v.
