A doctor, hospital and health care foundation have been sued by a mother and her infant daughter for medical malpractice during delivery.

Kyna Mitchell and her daughter filed the lawsuit in Madison County Circuit Court, against Alton Memorial Hospital, Southern Illinois Health Care Foundation Inc. and a doctor involved with the vacuum-assisted delivery.

Mitchell was admitted to the hospital on Feb. 20, 2007, for labor induction because of pre-eclampsia at term. According to the lawsuit, the doctor attempted vacuum-assisted delivery multiple times and failed. The lawsuit alleges that after the release of the vacuum cup and completion of delivery, the shoulder where the vacuum cup was attached was weak and “suggestive of Erb’s palsy.”

According to the lawsuit, the vacuum procedure caused a brachial plexus injury and permanent nerve root damage. Brachial plexus injuries are one of the more common types of birth injuries, and can often be caused by medical malpractice during the labor and delivery process. In order to prove the case, the plaintiff must show that negligence occurred and that it caused the injury.

The lawsuit seeks damages of $150,000 or more, plus costs. The case number is 15-L-233 in Madison County Circuit Court.

Two Illinois transit districts have claimed immunity in a wrongful death case filed by a woman whose husband was killed while riding his bicycle along a trail.

The Agency for Community Transit in Edwardsville and the Madison County Mass Transit District have claimed immunity under the Tort Immunity Act.

According to the lawsuit, William Beltz was riding his bicycle along Schoolhouse Trail in Madison County when he was struck by a vehicle traveling along Route 111. Beltz died of his injuries. His wife, Mary Beltz, filed the wrongful death lawsuit.

The lawsuit claims that bicyclists must navigate the intersection of the trail with Route 111 by means of a crosswalk lacking signage warning of the intersection’s dangers. According to the complaint, William Beltz had no notice of the hazards he would encounter at the intersection. The lawsuit also alleges that prior to its reconstruction, the Schoolhouse Trail was 560 feet south of the intersection.

In a motion to dismiss, the two transit districts argued that, as public entities, they are immune under the Tort Immunity Act.
The defendants said that local public entities and employees are not liable under the Act for injuries caused by the failure to provide traffic control devices or by the condition of riding trails.

Judge Barbara Crowder of Madison County Circuit Court took the motion under advisement.

The lawsuit seeks a judgment of more than $400,000.

An Illinois widow has filed a wrongful death lawsuit against a psychiatrist, claiming improper treatment of her husband’s depression contributed to his suicide.

Robin Lynn, as Special Administrator of the Estate of Bradley Lynn, filed the lawsuit on June 21 in Madison County Circuit Court.

According to the complaint, Bradley Lynn sought treatment from a specialist in psychiatry and neurology for suicidal tendencies. Lynn’s wife claims that the psychiatrist failed to properly diagnose him with bi-polar disorder and failed to properly monitor him while he was prescribed medication.

The lawsuit alleges that Bradley Lynn’s depression became worse and he committed suicide several weeks after beginning treatment. Lynn’s wife accuses the psychiatrist of negligence in failing to recognize the seriousness of his disorder. The wrongful death lawsuit seeks damages in excess of $225,000 for medical expenses and costs of the lawsuit.
