It was 2013 when this ugly accident happened. The bar, Hopkins Icehouse, its owners and the defendant, Chad Caldwell, are being sued for the deaths of Tameka Pavon and Jercarlos Hawkins. Caldwell ran a red light on Sept. 29, 2013 and slammed into the vehicle carrying Pavon, Hawkins and a third individual, Genaro Camacho, who sustained a severe traumatic brain injury, from which he is not expected to totally recover.
At the time of the crash, Caldwell was charged by police for one count of intoxication assault and two counts of intoxication manslaughter. He landed in jail and is currently serving a 20-year sentence.
The lawsuit statement of claim alleges that Caldwell had been drinking heavily the night of the accident and that no one in the bar — managers or staff — did anything to stop him from leaving the premises even though they witnessed him, keys in hand, stagger out of the bar. In the ensuing fallout over who was in the wrong, the bar points fingers at the drunk driver, and the drunk driver points fingers at the bar.
The core of the argument is that Caldwell drank without being stopped, left the bar and killed two people and injured a third in an accident that should never have happened. This case may well end up with the bar owners and the driver being proportionately responsible for the devastating wreck that ended the lives of two young people.
