Plaintiff, Dawn Nettles, has filed her Plaintiff’s Notice of Appeal in her Fun 5’s lawsuit against the Texas Lottery Commission and GTECH Corporation. The notice declares that she is appealing two orders of the 16oth Judicial District Court in Dallas. The first Order granted sovereign immunity to the Texas Lottery Commission. The second Order granted “derivative” sovereign immunity to the lottery’s private operator GTECH Corporation. In essence, the court has ruled that neither the TLC nor the lottery’s private contract operator can be held responsible if they commit fraud on lottery players.
