Did unknown maintenance issues cause a gravel-filled truck trailer to crush a car and driver?

Lindsey Combs, a 32-year-old hairdresser, was killed in her driveway when a trailer, hooked to the back of a truck hauling gravel to a city project, fell over onto her car, crushing her to death. Her 4-year-old daughter watched on from nearby as it happened. Combs was two months pregnant at the time of the accident.

According to the police, Combs had been asked to move her vehicle just moments before the gravel truck toppled over onto her car. Law enforcement were at a loss to understand what happened, as the brakes had not locked, the load was not oversize or over-weight, and the truck operator had more than 25-years experience working a large rig and an impeccable safety record with no violations.

In a situation such as this one where there appears to be no explanation for such a horrific accident, the reason may involve improper maintenance, a faulty hoist, the truck cutting too close to the lip of a road or driveway or a driver being in a hurry to get the load dumped and not paying attention to their surroundings.

The family may wish to file a wrongful death lawsuit in the hopes of sending construction companies, as well as the owner of the gravel truck in question, a message relating to how maintenance of vehicles in their fleet and proper training of drivers and operators can make a huge impact on safety.

Personal injury attorneys rarely find that accidents are an unexpected, freak happening. In most cases there is negligence on someone’s part and that negligence caused serious injuries or death.
