Family of four survives head-on texting-and-driving collision

A mother and her three sons were travelling on the New York State Thruway when another driver slammed into their vehicle. The driver was texting behind the wheel. The four victims were seriously injured, and they chose to file a lawsuit to obtain compensation for their life-altering injuries.

According to the Centers for Disease Control, distracted driving causes nine deaths each day in the United States.

The woman’s northbound Ford Fusion was struck when a 22-year-old driver lost control of her Honda Civic while texting. Her vehicle sideswiped the family’s car, and both automobiles veered over the median into the northbound lane. As a result, the victims’ car was struck head-on and in the rear. The mother sustained rib and right ankle fractures. Her 24-year-old son suffered finger fractures and injuries to both his chest and arms. Her 22-year-old son sustained a wrist fracture and other injuries, and the 19-year-old boy was struck in the neck and back and required 80 stitches to close a wound on his brow.

The subsequent legal case settled out of court for $600,000. If the defendant feels his or her case is not very strong, he or she is likely to agree to an out-of-court settlement. In this case, texting clearly contributed to a serious accident for which the driver was plainly at fault. If the case had gone to court, the jury award may have been higher.
